Abstract: Nos encontramos en un país donde la flexibilización laboral es una práctica
cotidiana empezando desde la producción normativa, su aplicación tanto en el nivel
judicial y administrativo; y en este sentido el Derecho Laboral está anclado o sujetado
en pilares que lo denominamos principios del Derecho Laboral que son: el Principio de
Protector y sus reglas (in dubio pro operario, la norma más favorable y la condición
más beneficiosa), Principio de Irrenunciabilidad, Principio de Continuidad de la
Relación Laboral, Principio de Primacía de la Realidad, Principio de Razonabilidad,
Principio de Buena Fe, entre otros, estos principios son el sostén de la disciplina del
derecho laboral que no es exactamente producto del Estado ni tampoco de las
voluntades de las partes sino de las investigaciones y estudios realizados por los juristas
especializados en materia laboral. Existe la idea que al estar en esta denominada
flexibilización laboral justamente se tiene que debilitar (vulnerar) estos principios para
poder afectar “legalmente” derechos de los trabajadores, para ello se requiere una
normativa que afecte tales principios del derecho laboral desde el momento de su
producción (pese a que inclusive muchas normas son inconstitucionales tal como
veremos) y también en algunos caso una complaciente jurisprudencia que no se le dé el
sentido exacto de los principios del derecho laboral, por lo mismo que realice la
presente investigación, en tal sentido esta investigación me permitió ver si están
vigentes los principios del derecho laboral en la legislación laboral peruana desde su
producción normativa, su aplicación y también si existen principios del derecho laboral
que se están inaplicando, para tener unas conclusiones con sustento científico. Así
mismo realizamos un análisis tomando en cuenta la legislación comparada como es la
argentina, chilena, mexicana y la española y de esta manera tener una idea mucho más
grande de que es lo que está ocurriendo en otras realidades y si existe relación con lo
que ocurre en nuestro país. Hacemos la precisión que esta investigación se realizó en
cada uno de los principios del Derecho Laboral.
We are in a country where labor flexibility is a daily practice starting from normative production, its application both at the judicial and administrative level; and in this sense the Labor Law is anchored or held in pillars that we call the Labor Law principles, which are: the Protective Principle and its rules (in dubio pro operario, the most favorable norm and the most beneficial condition), the Irrevocability Principle , Principle of Continuity of the Labor Relationship, Principle of Primacy of Reality, Principle of Reasonableness, Principle of Good Faith, among others, these principles are the support of the discipline of labor law that is not exactly the product of the State nor of wills of the parties but the investigations and studies carried out by lawyers specialized in labor matters. There is the idea that being in this so-called labor flexibility, these principles have to be weakened (violated) in order to be able to “legally” affect the rights of workers, for this purpose, a regulation that affects such principles of labor law is required from the moment of their production (although even many standards are unconstitutional as we will see) and also in some cases a complacent jurisprudence that does not give the exact meaning of the principles of labor law, for the same reason that we carry out the present investigation, in this sense this Research allowed us to see if the principles of the legal right in the Peruvian labor legislation are in force since its normative production, its application and also if there are principles of the labor law that are not being applied, to have conclusions with scientific support. We also carry out an analysis taking into account the comparative legislation such as Argentina, Chile, Mexico and Spain and in this way have a much bigger idea of what is happening in other realities and if there is a relationship with what happens In our country.
