Resumen: La presente investigación titulada “El mejor derecho de propiedad a partir del
análisis en el Sistema Registral Peruano” tuvo como objetivo general “Analizar el mejor
derecho de propiedad en el Sistema Registral peruano”, utilizo un diseño de enfoque
cualitativo, de tipo básico, alcance descriptivo y exploratorio y diseño hermenéutico, se
desarrolló en el departamento del Cusco, para el recojo de la información se contó con
seis juristas especialistas Derecho registral y notarial siendo seleccionados por
conveniencia y en base a su experiencia, tomó como técnica el análisis documental y la
entrevista y como instrumentos utilizó una bitácora de documentos y la guía de entrevista.
Resultados: el mejor derecho de propiedad es considerado una facultad de la
propiedad que permite defender y oponer tu derecho frente a otro sujeto que reclama el
mismo inmueble, sin embargo, no respeta los principios fundamentales puesto que existe
contradicciones en la ley y jurisprudencia entre las debilidades están (i) el carácter
facultativo del registro de bienes inmuebles contradictorio con el art. 2022° del Código
Civil (ii) por un lado el Código Civil sostiene el Sistema Consensual (art. 949°) y por otro
lado, solo se puede oponer tu derecho cuando este está inscrito (art. 2022°), (iii) la falta
de agrupación de las leyes sobre propiedad en un solo marco normativo a generado
contradicciones entre la normativa, (iv) La falta de un único sistema de Catastro entre
Agricultura y SUNARP y (v) la falta de un criterio nacional de que áreas son dedicadas
exclusivamente a la agricultura, cuales son proyectadas para las futuras habilitaciones
urbanas y cuáles serán destinadas para los proyectos de infraestructura. En la Región del
Cusco y en general en el estado peruano este tipo de conflictos han surgido y vienen
surgiendo principalmente por (i) la conducta fraudulenta de las personas, (ii) el error
humano y (iii) la demora en el funcionamiento de la oficina de catastro y (iv) los títulos
dados por COFOPRI que contribuyo a la aparición de casos de oposición de derechos.
The present investigation entitled "The best property right from the analysis in the Peruvian Registry System" had as general objective "Analyze the best property right in the Peruvian Registry System", I use a qualitative approach design, basic type, scope descriptive and exploratory and hermeneutical design, it was developed in the department of Cusco, for the collection of information there were six legal specialists in Registry and Notarial Law, being selected for convenience and based on their experience, using documentary analysis and interview and as instruments used a document log and the interview guide.
