This research paper was titled “Regulating the Legal Prerequisites for Assessing the Rational Need for Means Used in Legal Defense in Peru”. As is well known, legal protection is a cause of justification that legitimizes an attack on another person or group of persons, a legally protected product. However, for this to be permitted, three requirements must coincide, namely: an unlawful attack, a rational need for the means used to prevent or avoid it (...), and the lack of sufficient incitement by the person defending. Against this background, the legal defense in the criminal law of Peru reveals problems with the second requirement, so it is violated due to non-compliance and improper application, either due to ignorance or due to the fact that the rule prescribing the legal prerequisites was not applied properly. ... legal protection or simply for non-compliance with the criminal code, political constitution, etc. In this sense, the purpose of this research work will allow to identify and solve this socio- legal problem using the legal prerequisites included in the second mandatory requirement - a rational need for the means used to prevent or avoid it - by studying the current regulations in order to propose alternative legal prerequisites, such as defining legal protection from the objective point of view of a third professional observer; the emotional state of the attacked during defense; and, finally, the assessment of the legally protected product during protection; which, if taken into account, are intended to help judges better interpret the rule in terms of the legal prerequisites for legal protection.
