The present research entitled: "Labor informality amongst delivery service workers and the lack of protection against occupational hazards in the city of Cusco between 2020 - 2022", had the objective of analyzing the causes of the increase of labor informality in delivery services; likewise, it will be analyzed whether this new form of business violates the labor rights of the national workers. The research has been divided into five chapters. The first chapter addresses the problem statement, which explains how the exponential growth of labor informality in delivery services has caused a large number of workers to be exposed to a variety of labor adversities, including the lack of protection against occupational hazards. At the same time, the labor market has been extended by means of virtual applications, which as a result of the pandemic had a great acceptance in the population; however, since it is a new form of work and it is not regulated in Peruvian legislation, it is relevant to study the compliance of basic labor rights for delivery workers, in order to reduce the rate of informality in this sector. Likewise, the research questions and objectives, as well as the justification and delimitation of the study are presented. The second chapter deals with the theoretical framework, in which we will see the international and local background, and then we will make an introspection about the generalities of the Right to Work where we will see the requirements to establish an employment relationship and then we will go into the delivery services and the exponential increase of informality in recent years in this sector, We will then discuss the functions of the regulatory bodies and their performance in the fight against informality, to finally mention the legislation applied at the international level for the recognition of delivery services as a formal job and to make an analysis of the legislative projects that were tried to be implemented in Peru in the last years. Similarly, the third chapter presents the methodology in which a qualitative approach was chosen, responding to the basic research and resorting to the grounded theory design. Likewise, the survey and interview were applied as a data collection technique, applying the surveys to the delivery workers and the "interview guide" to the labor lawyers of the GRTPE as an instrument; being presented to 5 specialists in Labor Law. In addition, a documentary analysis of the SUNAFIL report on the policies adopted to combat informality in delivery services was applied, and this information is included in the annexes. Finally, we drafted a proposal for a law project to formalize independent delivery workers, respecting their flexible schedules and establishing a special form of contracting for this sector, also trying to ensure that their labor rights and the correct labor protection for this new sector are duly complied with.
