The present investigation makes an analytical study of the forbidden evidence in Peruvian law. That is to say, it examines how it is regulated in the criminal procedure and which are the theoretical- doctrinaire foundations that hold its implementation. In this manner, the various theories that explain and justify this institution in the criminal procedure are learnt. Thus, the study has verified the presence of strict standpoints that deny the legitimacy of evidence obtained in violation of individual rights, and those that advocate for the relative assessment of such evidence or, depending on the specific case, an application of the forbidden evidence exclusionary rule. In the second part of the study, an analysis of the Peruvian case-law regarding forbidden evidence has been made. It reflects the opposing positions in the resolutions issued by the Peruvian courts. With that in mind, it is to say that this topic will continue to be matter of a national endless debate.
