This research work is based on an objective fact that has both legal and social nuances, we refer to the regulation of the principle of opportunity in Peru, therefore we understand the principle of opportunity as a means by which processes end quickly benefiting the accused and the victim with an effective process to support why the application of the Opportunity Principle does not work optimally, many reasons are advanced, among which we can mention: the fact of having a slow and burdensome Judicial System for those involved in criminal proceedings , including the victim of the crime, despite the fact that access to justice is free; Therefore, it is urgent to look for the factors that are limiting their application and correct them so that they effectively comply with the principles of procedural efficiency and speed, in order to seek a prompt solution to a criminal conflict and avoid prejudice to those in the cases of scarce and less social relevance. Another reason given is the delay that occurs in criminal proceedings, since one of the effects of the application of the Opportunity Principle must be the early conclusion of a criminal investigation, which means, economic savings for the State, which it will not have to continue generating expenses in logistics and personnel material, being able to allocate it to other tasks; for the parties, the saving consists of stopping wasting time, going to the judicial premises to practice diligences and negotiations and therefore, loss of money, even affecting their health, since, all litigation generates emotional unrest and also stigmatizes the who unfortunately have been involved in some crime and even the victim herself. It would also be that criminal law has been applied to behaviors that are not serious and that do not affect the public interest transcendently. Well; criminal doctrine, agrees to postulate that there are behaviors that are not serious and, therefore, do not affect the public interest transcendently; In this way, Criminal Law must be used when absolutely necessary, that is, it must be the last reason for its use, allowing the parties in conflict to have their claims protected, exercising them in other legal means such as the Principle of Opportunity, through conciliation; that is, only Criminal Law should be used as a last resort or of strict necessity (last ratio).
