Abstract: El presente trabajo de investigación parte de un hecho objetivo que posee matice tanto jurídicos como sociales, nos referimos a la regulación del principio de oportunidad en el Perú, entendemos pues al principio de oportunidad como un medio por el cual los procesos terminan rápido beneficiando al imputado y a la víctima con un proceso eficaz para fundamentar por qué no funciona óptimamente la aplicación del Principio de Oportunidad, se esgrimen muchas razones, entre las cuales podemos mencionar: el hecho de tener un Sistema Judicial lento y oneroso, para los involucrados en un proceso penal, incluida la víctima del delito, a pesar de que el acceso a la justicia es gratuita; por ello, es que urge la necesidad de buscar los factores que vienen limitando su aplicación y corregirlas para que cumplan con efectividad los principios de eficacia y celeridad procesales, a efectos de buscar una pronta solución a un conflicto penal y evitar perjuicio a los justiciables en los casos de escasa y menor relevancia social. Otra razón esgrimida es la dilación que se produce en los procesos penales, puesto que, uno de los efectos de la aplicación del Principio de Oportunidad, debe ser la pronta conclusión de una investigación penal, lo que significa, ahorro económico para el Estado, que no tendrá que continuar generando gastos en material logístico y de personal, pudiendo destinarlo a otras labores; para las partes, el ahorro consiste en dejar de perder tiempo, concurriendo a los locales judiciales para practicar diligencias y gestiones y por ende, pérdida de dinero, afectando incluso su salud, puesto que, todo litigio genera intranquilidad emocional y además, estigmatiza a los que por desgracia se han visto envueltos en algún delito e incluso a la propia víctima. También sería, que el Derecho Penal se viene aplicando a conductas que no son graves y que no afectan en forma trascendente el interés público. Pues; la doctrina penal, coincide en postular que existen conductas que no son graves y que, por lo tanto, no afectan en forma trascendente el interés público; de esa manera, el Derecho Penal, debe utilizarse cuando resulta absolutamente necesario, esto es, debe ser la última razón para su utilización, permitiendo que las partes en conflicto, puedan tener amparo de sus pretensiones, ejercitándolas en otros medios legales como el Principio de Oportunidad, mediante la conciliación; es decir, sólo debe utilizarse el Derecho Penal como un último recurso o de estricta necesidad (última ratio).
This research work is based on an objective fact that has both legal and social nuances, we refer to the regulation of the principle of opportunity in Peru, therefore we understand the principle of opportunity as a means by which processes end quickly benefiting the accused and the victim with an effective process to support why the application of the Opportunity Principle does not work optimally, many reasons are advanced, among which we can mention: the fact of having a slow and burdensome Judicial System for those involved in criminal proceedings , including the victim of the crime, despite the fact that access to justice is free; Therefore, it is urgent to look for the factors that are limiting their application and correct them so that they effectively comply with the principles of procedural efficiency and speed, in order to seek a prompt solution to a criminal conflict and avoid prejudice to those in the cases of scarce and less social relevance. Another reason given is the delay that occurs in criminal proceedings, since one of the effects of the application of the Opportunity Principle must be the early conclusion of a criminal investigation, which means, economic savings for the State, which it will not have to continue generating expenses in logistics and personnel material, being able to allocate it to other tasks; for the parties, the saving consists of stopping wasting time, going to the judicial premises to practice diligences and negotiations and therefore, loss of money, even affecting their health, since, all litigation generates emotional unrest and also stigmatizes the who unfortunately have been involved in some crime and even the victim herself. It would also be that criminal law has been applied to behaviors that are not serious and that do not affect the public interest transcendently. Well; criminal doctrine, agrees to postulate that there are behaviors that are not serious and, therefore, do not affect the public interest transcendently; In this way, Criminal Law must be used when absolutely necessary, that is, it must be the last reason for its use, allowing the parties in conflict to have their claims protected, exercising them in other legal means such as the Principle of Opportunity, through conciliation; that is, only Criminal Law should be used as a last resort or of strict necessity (last ratio).
