This study describes the media concentration of the mass media in Peru, especially in the written press, as well as the efforts that should be made appealing to jurisprudence, for the elaboration of a legal body that contributes to correct the situation. Since 2013, with 80% of the written press under the control of the El Comercio group, our country shows the highest concentration of mass media among the nations of the region, undermining the diversity of information, one of the foundations of democracy. Therefore, this study proposes to the public authorities to organize a legal body to prevent both the private and the State from concentrating the media power that affects information pluralism and, consequently, democracy. Faced with the deterioration of contents and the absence of contrasts in information and commentaries, the work also recommends self-regulation by institutionalizing especially in the large written press the figure of the Ombudsman or reader's Defensor, as internal critic to avoid, above all, the excesses that damage the honor and prestige of individuals and institutions. Likewise, it proposes to the Congress of the Republic to approve a regulation by establishing limits to the ownership of the written press, as it already happens with the restrictions on the use of frequencies by radio and television. Finally, it proposes to the Judiciary to establish a firm jurisprudence in response to the claims done by a group of journalists against the media concentration of the big press. Eight years have passed since the claims in 2013 and so far, the problem remains in court. Finally, the conclusions of this report show the unconstitutionality of media concentration, since it threatens free competition in a social market economy, as stated in Article 61 of the Constitution, which prohibits the monopoly of mass media. It is therefore recommended that the government enforce the provisions of the Constitution in relation to the ownership, use and access to the press. However, with all these limitations, the press in democratic countries is much freer and more varied than the press in countries with dictatorial governments, where the press is captive and the official word is the only version that is disseminated.
