This research work focuses on the ruling issued in Judicial File No. 00568-2021-0-1817- SP-CO-02, which decides on the annulment of an arbitration award. Therefore, whether or not this annulment appeal is admisible, constitutes the main problem of this legal report, for which we will delve into the evaluation of the standard of motivation required for judicial resolutions, and whether these can be applicable to arbitration awards, by virtue of the provisions of the current Arbitration Law, the Giuliana Llamoja binding precedent, and the Fernando Cantuarias binding precedent. Likewise, we will question whether this action would represent a substantive review of the arbitration award, by the Commercial Chamber, and whether the Arbitration Court was authorized to grant compensation based on a public contracting principle. In that sense, we will respond that the arbitration award should not have been annulled, since the causes invoked by the plaintiff were not applicable to the contested award, nor did they justify declaring part of it null. This analysis has determined that the requirement of motivation for the arbitration award, when equated to the same standards of judicial motivation, has violated the nature of the arbitration process, causing the improper annulment of the award.
