Preventive detention is legally considered as a personal precautionary measure, by means of which the person is deprived of one of their fundamental rights: freedom, for this reason the present study aims to analyze this measure, in our country, which would be due to a non-existent or apparent motivation in the resolution. The information collected and analyzed has been from the files with Preventive Prison orders of the Superior Court of Justice of Callao. The review of files for the year 2017-2020 has been chosen and finally taking a sample of 12 files for the respective study. An attempt was made to answer the main question, to what extent does the application of preventive detention as a coercive measure without due motivation violates the constitutional right to liberty? For this, the relationship between preventive detention with the principle of due motivation and the Constitutional Right to freedom has been raised using the qualitative method, the value proposition defined in this research is during the last 03 years what allows us to have a updated information on the treatment of the figure of preventive detention in the Jurisdiction of the Superior Court of Justice of Callao, reaching the conclusion that many of the preventive detention orders are not duly motivated, and there is insufficient and apparent motivation, which leads to the violation of the right to freedom of the accused.
