ABSTRACT In the last decade, the Peruvian labor law has made a major transformation as a result of the work of the Constitutional Court. There has been a reform or restructuring regarding the efficacy of the effects of dismissal, the constitutionality of certain special regimes, among other matters of relevance. Both the supreme interpreter of the Constitution and the Supreme Court of Peru have issued binding case law relating to the job security of union employees, pointing generically reaching them relative stability, but not absolute, represented by replenishing in office. Then, in the development of this research will attempt to explain how these judicial pronouncements and their effects, are used by servants and public officials in order to obtain an economic benefit from fraud to law. This research was conducted methodologically into three parts: i) The development of the problem and approach the goals that helped arrive at accurate conclusions; ii) Analysis of the information obtained after the application of instruments; iii) Finally, obtaining results that allowed be the subject of discussion, in order to reinforce our research hypothesis. This study is innovative because it not only tried to analyze theoretical criteria but, they look through cases and interviews with distinguished Peruvians labor lawyers, to show that public administration are operators despite the respect and the principle of good labor faith and respect a professional code of ethics.
