This thesis analyzes the principle of proportionality in the application of preventive detention, proposing an analysis around the national and comparative doctrine, addressing the motivations of the proceedings of this precautionary measure, investigating whether they have been properly used, both at starting from their material presuppositions, their elements and their effects, to later establish whether the fundamental rights of the defendants have been violated. In chapter one the problematic reality and the problem, objectives and hypotheses are developed. In the second, the background to the topic and the theoretical bases of the three variables. In the third, the research design, as well as the techniques, instruments and procedures used. In the fourth, the results obtained through expert judgment, documentary analysis and jurisprudential analysis. Finally it is discussed with the antecedents. The thesis used a quantitative, descriptive and non-experimental approach. The results show that there is a link between proportionality and preventive detention in the case of the crime of collusion. It was concluded that doctrinal unanimity on this figure does not correspond to criminal practice since the judiciary applies, under different reasons, said measure, violating in certain cases the presumption of innocence and individual freedom
