ABSTRACT This research deals with the analysis of the buying process regulated for Programa Nacional de Alimentación Escolar Qali Warma to determine its proper functioning and improvements that can be included specifically in the subject of administrative sanctions that have not been applied to those suppliers who fail to comply with their contractual terms, analyzing the relevance of the supplementary application of the Government Procurement Act and its regulations recently amended. It specifies that the research includes data and analysis during the first three years of the program since its inception in 2013 until 2015. In the first chapter Law No. 29951- Law Public Sector Budget for Fiscal Year 2013, objective, scope and specifically the Eighty Fourth Supplementary Provision Final will be analyzed. In the second chapter Process Purchase Qali Warma within it the regulatory framework, scope and program beneficiaries, products and rations provided through it, structure and organization of it develops. In the Third Chapter the provisions contained in the Manual Purchase be analyzed, processes that are regulated in it with each of its stages, penalties and contract terminations that apply in these purchasing process as well as the list of suppliers sanctioned during the first two years of the program. In the fourth chapter the general notion of sanctioning power, fundamentals and classification of administrative penalties, the Peruvian regulation in this regard and principles that regulate it will develop. In Chapter Five theme Public Procurement, definition, general, administrative sanctions on state contracts and the OSCE governing body will develop. It is so, the researcher, after analyzing the behavior of suppliers sanctioned by Qali Warma during the first two years of the program concludes that require supplementary implementing the Law on Government Procurement and its Regulations in order to assess the sanctioning power State their suppliers who fail to comply with its provisions.
