The objective of this research effort is to develop the constitutional legal matter from File N°02695-2021-PA/TC which was debated in the Plenary. Sentence 50/2023; since, the entity of Reniec by placing the paternal surname first and the maternal surname, without prior notice to the mother, who initially recognized the minor individually; and, therefore, gave both of her surnames to the girl, a violation of the mother's right to equality and non-discrimination on the basis of sex would be generated, as well as the right to identity with respect to the minor. Therefore, we have considered to be guided by the pronouncement of the Constitutional Court in the extreme of the interpretation that it assigns to article 20 of the Peruvian Civil Code, regarding the choice of the order of surnames, since the same regulations do not specify an order, for the registration of surnames, generating a free interpretation by the parents to be in said figure, providing them with an adequate right to equality, as well as the possibility of decision in the order of choosing surnames that would be assigned to their minor without infringing the fundamental rights of the minor. As a result, we have selected this ruling, since, today, the impact on the right to equality and non-discrimination can be observed when choosing the order of a minor´s surname, also involving their right to identity.
