The present investigation has sought to problematize about 2 legal rules contained in the Civil Procedure Code; For this reason, it is that the title of the investigation revolved around article 8 and article 438 paragraph 1, of the aforementioned normative body. Thus, with the help of national and comparative doctrine; and, with the analysis of the legal rules that deal with this category, it has been possible to understand this problem and a general conclusion has been reached: The legal grounds to affirm that the determination of competence occurs at the time of the filing of the claim , in the Peruvian civil process are; in the first place, the effective judicial Protection, since this implies an adequate and effective protection by the State to the defendants; another foundation is in the understanding that the civil process begins with the filing of the lawsuit; and, this foundation is connected to the effective jurisdictional Guardianship. Another of the foundations is the principle of immediate application of the law, the same one that even has Constitutional support, the same one that is consistent with the principle of the non-retroactivity of the law. Another foundation would come to be constituted by the second final provision of the Civil Procedure Code, the same one that regulates the ultra-activity of the procedural norms; However, what has been said before, one of the reasons would come to make the economy and procedural speed; Therefore, the fact that jurisdiction can be determined after this moment would imply the possibility that the process may be undergoing changes in jurisdiction that would lead to unnecessary delays in the process
