The following paper has been drawn up through the analysis of the Resolution No. 186-2021/CCD-INDECOPI, which holds great importance as it has been approved as a binding precedent for cases involving unfair competition due to acts of deception in the setting of misleading discounts. In this regard, we question whether or not there has been an artificial increase in prices in this case and whether such restrictive regulation violates the freedom of enterprise and free competition. In that way, we divide the work into three chapters ordered as follows: The first chapter, narrates the case in question, elucidating the most significant foundations of the pronouncements made by the Commission on Unfair Competition Control in relation to the imposed sanctions. Additionally, we analyze the criteria taken from the United Kingdom regulation. The second chapter delves deeper into the conceptual bases that serve as grounds for the subsequent analysis addressed in the next chapter. This research offers insightful perspectives on the topic of unfair competition, acts of deception, fictitious pricing, freedom of enterprise, free competition, and the guiding principles of reasonableness and truthfulness, in the framework of the rights set forth in the Code of Defense and Protection of the Consumer. In the third chapter, following our comprehensive analysis, we assert that the Commission's pronouncements were inadequate. As a result, we asseverate that the criteria applied should be adapted to the Peruvian context while ensuring the preservation of the aforementioned fundamental rights. To this end, we propose a new framework for analysis.
