This topic is addressed in relation to Ruling 477/2021, issued by the Constitutional Court, which considers the transgression of the right to reasonable time in criminal proceedings in relation to the right to personal liberty in crimes against the patrimony of the State, directly in a case of embezzlement. Our work seeks to demonstrate the relevance of reasonable time in criminal proceedings, in relation to due process, which must be understood as a fundamental guarantee against the accused, in this case Mr. Juan Roberto Franco Zapata, who was prosecuted for the commission of the crime. In this sense, for the respective analysis we will use different sources such as, regulations and bibliography referred to the criminal process, background, legislation, and the different theories that review the term as a measure of time in criminal proceedings. In this order of ideas, we will make a detailed analysis of the content of the sentence, and we will explain the reason for our position, which is inclined to the decision taken by the majority of the judges of the Constitutional Court. Finally, the present work has a special condition since it deals with a process that deals with the violation of individual freedom in relation to the lapse of time that our courts take when resolving a process, a fact that we consider substantial for the legal debate in the context of a Professional Sufficiency Work.
