The present work of professional sufficiency entitled “The psychological reports of the CEM and their probative value in cases of psychological violence“ which was carried out in merit of the cassation 1293-2021 Piura, being carried out in the present, The present study analyses the value given to both the psychological reports of the Women's Emergency Centre and the psychological expert reports of the Institute of Legal Medicine, which although issued by specialists in the area of mental health such as psychologists, in the case of the expert reports, the specialist, in addition to having this degree, has the speciality of expert witness, which has been shown to generate greater reliability for the Prosecutors of our country, despite the fact that law 30364 and its regulations grant evidential value to the psychological reports of the Women's Emergency Centre. On the other hand, during the course of this work, it has become evident that in neighbouring countries such as Chile, Colombia and Ecuador, justice operators base their decisions on psychological expert reports, most of which are provided by the parties and not by a state area designed for such purposes, as is the case with Legal Medicine in our country. Thus, the most relevant conclusion is that psychological reports issued by the CEM should and can be assessed in the same way as a psychological expert opinion of IML as long as they comply with the objectivity required for these cases, which does not imply subsequent inconsistencies in the trial.
