The purpose of this paper is to analyze Judgment 207/2020, which is one of the most important judgments of the Constitutional Court regarding the content of the principle of good faith in public registration and the possibility of maintaining the protection of the third party acquirer protected by this legal rule, even when in the chain of transfers prior to or prior to its acquisition there is a false act registered, namely, that it was made by virtue of an instrument that was materially forged or obtained by impersonating the identity of the true owner. To this end, various sources have been used, from judgments of the Constitutional Court and the Registry Court, as well as registry and civil doctrine that, with their contributions in books and scientific essays, have allowed us to build a delimited idea of public registry good faith and the great challenge for its operation in our legal system in the face of the registration of forged titles. This paper develops our critical position and the fundamental contributions of the Judgment under analysis, since, although it is true that the declaration of constitutionality of Article 5 of Law 30313 has ratified a possible interpretation of Article 2014 of the Civil Code, the Constitutional Court has constructed for these cases a different notion of good faith in the registry. so that it is not only understood as legitimate ignorance of the extra-registry circumstance that vitiates the transfers, but also as diligent behavior displayed by the acquirer.
