The main theme of this research work is to make known the legal and social importance of blended families within family law in Peru. This legal subject is presented during the session of the Plenary of the Constitutional Court, dated October 20, 2020, which declared the amparo (a type of constitutional remedy) lawsuit that gave rise to Case No. 01849-2017-PA/TC as well-founded. In this regard, we posit that the distinction between biological children and stepchildren or related children clashes with what is established in Article 4 of the Political Constitution of Peru since it results in the lack of protection for the family as an institution fundamentally recognized in Peruvian legislation. To address this, we will analyze the existing theoretical foundations regarding the regulations related to “emotional social kinship“ and the need to include blended families as part of constitutional protection. In this line of thought, it is important to mention that various relevant bibliographic sources have been incorporated into this work. These sources were selected from legal journals, academic articles, and reliable resources that specifically address the research topic. This methodology allows for an informed perspective regarding the legal protection of blended families. Finally, based on the above, we observe the need to provide a stronger legal foundation for blended families in order to ensure that current legislation is not indifferent to the behavior and relationships in social life.
