The purpose of this work is the development of Cassation No. 1480-2017-Cusco, which deals with the matter of Divorce by Cause of Separation of Fact and Adultery, where certain parameters were determined regarding the injured spouse, to whom should correspond the compensation or the preferential award of the assets of the marital partnership, since, it is intended to compensate the damage caused, taking into account equity and family solidarity. The cause of de facto separation, which is understood as the suspension of the cohabitation between the spouses, either by unilateral or joint decision, has been chosen as the subject of research. For the development of the work, the use of Law 27495 has been used, which incorporates the de facto separation as a cause for separation of bodies and subsequent divorce, as well as doctrine obtained from the academic repository, and jurisprudence based on the Third Plenary Civil Cassation. Finally, the dupla chose the referred sentence as it is oriented by the branch of Family Law as it is the area in which issues related to the protection of the family figure are covered, as well as aspects related to the dissolution of the same, which is reflected in the subject of divorce, which in most occasions leaves as a result a damaged spouse and in case of having procreated, also their children.
