Since the adoption of the International Convention on the Rights of Persons with Disabilities in 2006 and its entry into force in 2008, the States Parties, including Peru, aligned in their national legislation new concepts and guiding principles that allow, among others, to provide greater protection for persons with disabilities against employment discrimination, one of these measures is the obligation of public and private employers regarding the implementation of reasonable accommodation. In this context, in the present Work of Professional Sufficiency, under the facts contained in Case 03835-2017-PA resolved by the Peruvian Constitutional Court and from the exhaustive review of national and international regulations, articles, journals, reports and books, the context of the current labor situation of persons with disabilities will be analyzed and we will deepen the legislative progress of the implementation of reasonable accommodation, highlighting what has been achieved at the national level and reviewing some cases of comparative international vision regarding the proposed topic. Under consideration that, although there is a normative advance in the Peruvian national regulation regarding the implementation of reasonable accommodation, there are still areas to improve and develop. Therefore, we describe and propose new contributions in order to improve the effective and efficient functioning of the implementation of reasonable accommodation by employers as well as by the supervisory authorities at the national level.
