The present investigation deals with Cassation No. 26544-2019, which reverses the grounds presented by both the Directorate of Distinctive Signs (DDS) and the Intellectual Property Court (IPC) of INDECOPI in response to the denial of the application for registration of the distinctive sign “SUEÑO DE ANGEL”. The controversy is based on the interpretation of the criteria established in Legislative Decree N° 1075, which indicates the elements to be taken into account to determine the similarity that may exist between two distinctive signs capable of confusing the consumer. Given the refusal of the DDS and the IPC, which deny the registration of the requested distinctive sign as a product trademark, as they consider that there was a risk of confusion, the applicant files a Contentious-Administrative lawsuit with the aim of having this decision reversed. The present study is based on jurisprudence, doctrine and regulations to conclude that the Supreme Court of Justice of the Republic incorrectly interpreted what is regulated in article 45 of Legislative Decree N° 1075. Likewise, it allowed establishing the importance of the element called “conceptual similarity“ from the consumer's perspective.
