This professional sufficiency work is a critical analysis of the pronouncement of the Peruvian Constitutional Court in File No. 03383-2021-PA/TC in relation to the massive violation of the social rights of the inhabitants of the district of Punchana in the Loreto region as a result of the absence of a solid waste treatment system. provision of essential basic services, territorial development and the presence of a high degree of pollution-borne diseases; a situation that led the Peruvian Constitutional Court to declare the existence of an unconstitutional state of affairs. In this regard, we consider that the unconstitutional state of affairs is an ideal mechanism with which the Peruvian Constitutional Court can optimally resolve situations in which fundamental rights are massively violated; However, the existence of this type of scenario should not be expected to guarantee their protection, but rather, to promote timely and effective control by the responsible entities in their respective areas of competence, this will be achieved with the proposed regulatory change, which effectively addresses such situations, providing sanctions and preventive measures; Likewise, this modification of the legal framework represents a serious commitment to justice and equity, significantly improving the protection of fundamental rights. For the development of this work, a qualitative research was carried out, carrying out an analysis of the doctrine and jurisprudential interpretations that develop the concept of the unconstitutional state of affairs, as a legal remedy to resolve a massive violation of rights.
