The purpose of the VIII Plenum of Civil Cassation (Cassation No. 3006-2015, Junín), hereinafter referred to as the plenum, was to determine whether the legal act in which one of the spouses disposes of assets belonging to the community of property without the consent of the other spouse is considered a null, voidable or ineffective legal act. In addition, it sought to establish whether the nullity, voidability or ineffectiveness of said act can be opposed to the acquirer or not. The plenary session adopted the thesis of the nullity of the legal act for contravening a rule of public order which is article 315 of the Civil Code. In this sense, in this work it will be analyzed whether the decision adopted corresponds to the principles that inspire family law, for this a descriptive dogmatic method will be developed, we have resorted to the consultation of sources such as scientific articles, books, jurisprudence and regulations. Finally, we will provide our assessment as a group, justifying through legal and conceptual arguments why the execution of a legal act of disposition by only one of the spouses should be considered null and void, thus promoting the joint participation of both spouses.
