The purpose of this Professional Sufficiency Work is to evaluate the scope of paragraph 7) of article 66 of the Consumer Code. To achieve this goal, the duty of suitability of suppliers, the Pro-Consumer principle and the principle of Integration of the administrative litigation process will be jointly analyzed. Said analysis will allow us to express our position regarding the outcome of the Constitutional and Social Law Chamber of the Supreme Court in the cassation that is the subject of this work, and then present a proposal that aims to prevent interpretations such as that made by the plaintiff of the This case may violate the rights of consumers of the transportation service. In this way, we want to demonstrate how the Law must always be analyzed and conceived in its purest and most functional dimension to address any controversy; Rules or principles of administrative law are also used in the event of deficiencies or legal gaps within the processing of a Judicial Process. The competent Judge or the Chamber, taking into account the Principle of Integration, may assess the facts exposed in an Administrative Litigation Process also using tools of Administrative Law and the provisions of the Consumer Code (especially, suitability, Pro-Consumer principle and attribution of administrative responsibility), considering that the purpose of this rule is to protect consumer rights.
