This essay focuses on a protective action against a decision by the Registry Tribunal that ordered the registration of a zoning rectification by type of use, in a registry entry without the consent of the registered owner. A deficiency is highlighted in the special non-contentious administrative registry procedure, which allows interested third parties to present titles without previously notifying the registry holder, who in certain situations might not even want the change or mutation requested not consulted by said third party. This can harm the owners whose registration rights have been modified against their will. The legal problems identified include infringement of defense rights and due process, in addition to the protection of legal certainty and property rights. The sources consulted for the preparation of this report are relevant legislation for the case, jurisprudence, books, electronic journals, decisions of the Registry Tribunal, and rulings of the Constitutional Tribunal. This essay concludes that although the registry system allows the presentation of titles by interested third parties, this situation can be questioned in cases where the owner is harmed. It is suggested, as an alternative solution mechanism, the use of the registry alert computer system to address this problem without fundamentally altering the registry process and the temporary immobilization of entries. We emphasize the need to balance the efficiency of the registry procedure with the protection of the immutability of data advertised in the Public Registries.
