Resumen: Desde finales de los años 30, el cannabis sativa ha sido considerada como una
sustancia perjudicial para la salud en gran parte del mundo. Teniendo como
precursor de la prohibición al país de Estados Unidos de Norte América. No
obstante, hoy en día, luego de casi 80 años de su prohibición, año 2023, los
distintos descubrimientos científicos han conllevado que muchos países regulen
a la marihuana, hasta el punto de despenalizarla totalmente. Ejemplo de ello, es
el mismo país precursor de la prohibición EE.UU, donde se ha despenalizado
totalmente en 8 estados, incluyendo 29 estados donde se ha regulado el
consumo medicinal.
Perú, país donde se realiza la presente investigación, actualmente tiene un
marco normativo que regula y prohíbe el cannabis, de una menara confusa,
penalizando la comercialización de la planta, pero dejando vacíos legales
respeto al cultivo, tenencia y cultivo de la misma. Permitiendo que existan abusos
de parte de las autoridades a los consumidores.
La presente investigación, busca establecer un punto de vista objetivo y actual,
de la regulación prohibitiva que tiene el cannabis sativa dentro del marco
normativo peruano, con el fin de poder aclarecer y/o determinar, si dicha
regulación es realmente eficiente, eficaz y lógica con la realidad social del Perú,
y con los conocimientos que la ciencia nos ha traído.
Para poder determinar los puntos positivos y negativos de una regulación no
prohibitiva del cannabis sativa dentro del territorio peruano, se realizara un
análisis y comparación con la realidades sociales, políticas y económicas de los
países que han regulado la despenalización del cannabis, tanto en
Latinoamérica, América y demás continentes; con la realidad social, política y
económica del Perú

Peru, the country where the present investigation is carried out, currently has a regulatory framework that regulates and prohibits cannabis, in a confusing way, penalizing the commercialization of the plant, but leaving legal gaps regarding its cultivation, possession and cultivation. The present investigation seeks to establish an objective and current point of view of the prohibitive regulation that cannabis sativa has within the Peruvian regulatory framework, in order to clarify and/or determine if said regulation is really efficient, effective and logical. with the social reality of Peru, and with the knowledge that science has brought us.
