No
Since the late 1930s, cannabis sativa has been considered a substance that is harmful to health in much of the world. Having as a precursor of the prohibition the country of the United States of North America. However, today, after almost 80 years of its prohibition, in the year 2023, the different scientific discoveries have led many countries to regulate marijuana, to the point of completely decriminalizing it. An example of this is the same precursor country of the US prohibition, where it has been fully decriminalized in 8 states, including 29 states where medicinal consumption has been regulated. Peru, the country where the present investigation is carried out, currently has a regulatory framework that regulates and prohibits cannabis, in a confusing way, penalizing the commercialization of the plant, but leaving legal gaps regarding its cultivation, possession and cultivation. Allowing for abuses by the authorities to consumers. The present investigation seeks to establish an objective and current point of view of the prohibitive regulation that cannabis sativa has within the Peruvian regulatory framework, in order to clarify and/or determine if said regulation is really efficient, effective and logical. with the social reality of Peru, and with the knowledge that science has brought us. In order to determine the positive and negative points of a non-prohibitive regulation of cannabis sativa within Peruvian territory, an analysis and comparison will be made with the social, political and economic realities of the countries that have regulated the decriminalization of cannabis, both in Latin America, America and other continents; with the social, political and economic reality of Peru
