The investigation presented as a problem, in what way the extrajudicial conciliation established in article 7 of the Conciliation Law - Law No. 26872 on shared tenure guarantees the principle of the Higher Interest of the Child in Peru ?, posing as hypothesis, the Extrajudicial conciliation established in article 7° of the Conciliation Law - Law No. 26872 on shared tenancy does not guarantee the principle of the Higher Interest of the Child in Peru because criteria and procedures that guarantee its application are not indicated. The design of contrast for the hypothesis was not experimental or descriptive longitudinal, the methods used were according to their purpose a basic investigation and according to its depth a correlational investigation, arriving confirm the hypothesis and establish as the main conclusion, that the extrajudicial conciliation contemplated in the article 7 ° of the Law of Conciliation on shared tenure in Peru does not guarantee the principle of the Higher Interest of the Child because criteria and procedures for its application are not established. Once the research hypothesis was confirmed, the incorporation of article 7°-B in the Conciliation Law was finally proposed, which establishes as criteria: guidance to parents on the meaning of shared tenure, that parents have a good paternal relationship- filial, uses and similar customs in addition to listening to the opinion of the girl, boy or adolescent, about the procedures: to carry out an interview to the members of the family with the interdisciplinary team, to carry out a psychological evaluation and social report to the members of the family, have an adequate environment to listen to the opinion of the child or adolescent, in the extrajudicial conciliation on shared tenure in Peru, in order to guarantee the principle of the Higher Interest Child.
