This thesis has been called “The Citizen Participation in the Environmental Impact Assessment System in the Mining Sector and the legal protection of the environment““, and is oriented to determine if the Citizen Participation in the Environmental Impact Assessment System in the sector Guarantees adequate legal protection of the environment. To achieve this objective, a doctrinal and legislative analysis has been carried out. Logical and legal methods have been used, such as doctrinaire and legal hermeneutics, with the objective of analyzing each variable and interpreting the norms and principles of the legal system in environmental law, based on the most relevant opinions of the doctrine. In addition to concluding the present study, it is determined that citizen participation, besides being a constitutional right, is presented as an important tool to ensure that the decision making around the development of mining projects consider the concerns of citizens who will be affected by the same. Therefore, it is necessary to better implement these mechanisms, strengthening citizens' knowledge regarding the scope of the right to participate, the spaces in which they can make use of it and the obligations of the State and companies during evaluation, approval and implementation Of mining projects. This will consolidate the decision-making processes, which will allow progress towards a sustainable development of the country, with respect to the rights of all Peruvians.
