La participación ciudadana en el sistema de evaluación del impacto ambiental en el sector minero y la protección jurídica del ambiente

Abstract

La presente tesis se ha denominado “La Participación Ciudadana en el Sistema de Evaluación del Impacto Ambiental en el Sector Minero y la protección jurídica del ambiente”, y se encuentra orientada Determinar si la Participación Ciudadana en el Sistema de Evaluación del Impacto Ambiental en el sector minero garantiza una adecuada protección jurídica del ambiente. Para cumplir con dicho objetivo se ha realizado un análisis doctrinario y legislativo. Se han empleado los métodos lógicos y jurídicos como el doctrinario y la hermenéutica jurídica, con el objetivo de analizar cada variable e interpretar las normas y principios del ordenamiento jurídico en materia de derecho ambiental, apoyándonos en las opiniones más relevantes de la doctrina. Además al concluir el presente trabajo se determina que la participación ciudadana, además de ser un derecho constitucional, se presenta como una herramienta importante para garantizar que la toma de decisiones alrededor del desarrollo de proyectos mineros considere las preocupaciones de los ciudadanos que se verán afectados por los mismos. Por ello resulta necesario la mejor implementación de estos mecanismos, fortaleciendo los conocimientos de los ciudadanos respecto a los alcances del derecho de participación, los espacios en los que pueden hacer uso de este y las obligaciones del Estado y empresas durante la evaluación, aprobación e implementación de proyectos mineros. Con ello se consolidará los procesos de toma de decisiones, que permitirá avanzar hacia un desarrollo sostenible del país, con respeto a los derechos de todos los peruanos.

This thesis has been called “The Citizen Participation in the Environmental Impact Assessment System in the Mining Sector and the legal protection of the environment““, and is oriented to determine if the Citizen Participation in the Environmental Impact Assessment System in the sector Guarantees adequate legal protection of the environment. To achieve this objective, a doctrinal and legislative analysis has been carried out. Logical and legal methods have been used, such as doctrinaire and legal hermeneutics, with the objective of analyzing each variable and interpreting the norms and principles of the legal system in environmental law, based on the most relevant opinions of the doctrine. In addition to concluding the present study, it is determined that citizen participation, besides being a constitutional right, is presented as an important tool to ensure that the decision making around the development of mining projects consider the concerns of citizens who will be affected by the same. Therefore, it is necessary to better implement these mechanisms, strengthening citizens' knowledge regarding the scope of the right to participate, the spaces in which they can make use of it and the obligations of the State and companies during evaluation, approval and implementation Of mining projects. This will consolidate the decision-making processes, which will allow progress towards a sustainable development of the country, with respect to the rights of all Peruvians.
