The protection of the family that orders the article 4 of the Constitution of Peru, beginning with the promotion of marriage due to forcing the same constitutional provision. Saving relation to the principle of form of marriage is also contained in the final paragraph of Article 4, it means that marriage is to be promoted concluded under civil law; thus established as the sole and mandatory to achieve the purposes specified in matrimonial law. This does not prevent the law in different ways marriage is contemplated, because in the end it always held in accordance with the law. Under the civil regulatory framework, the judge was the only jurisdiction to know and determine the claims of separation and divorce, leading to excessive judicial burden, delays and overspending processes that were impossible to assume for most of the population, thus creating a situation of informality. Therefore, the Congress decided to grant competition to municipalities and notaries for the dissolution of marriage, as long as both spouses agree and comply with the requirements of Law No. 29227 and its Regulations, approved by Supreme Decree Nº. 009-2008- JUS. Without detriment to, judges retain their competence to continue knowing cases of separation and divorce under civil law. In law No. 29227 does not refer to a period of reflection, unlike the provisions of Article 344 of the Civil Code that is 30 days after a single hearing, if one of the constitutional principles of the Family is the Promotion Marriage, then there should be a time of reflection on the Attorney and Municipal way for couples to make a little more conscientious when wanting to separate or take such drastic action, and ensure the welfare of the family, as well as each of its members.
