The present investigation touches on one of the problems observed and widely discussed in the justice administration system, which we have called ““FOUNDATIONS OF CRIMINAL POLICY THAT JUSTIFY THE CLASSIFICATION OF EXTORTION AS A CRIME OF MERE ACTIVITY““ This topic deals with the legal classification of the crime of extortion, but not from the point of view of criminal dogma, but basically based on pointing out that there are criminal policy foundations based on the constitutional order that allow this criminal type to be legislated, no longer as a type of injury or result, but given the current situation and the growth of this criminal modality and the birth of new forms of criminality, as a mere activity; that is to say, that the punishment barrier be brought forward, but not sanctioning preparatory acts as is done with the adjustment or marking of a very scarce criminal sanction, but rather that a result for its configuration is not required of the extortive conduct, but rather that this be consumes with the mere performance of the conduct, but with the same penalty entity, that is, maintaining the penalty that is currently imposed for this punishable act.
