The thesis entitled: “ARTICLE 505 INCISATION 4 OF THE CIVIL PROCEDURE CODE AND THE PRINCIPLE OF JURISDICTIONAL PROTECTION IN PERU“, seeks to problematize regarding one of the special requirements that the law (the Civil Procedure Code) requires of the person seeking file a claim for acquisitive prescription of ownership. In this sense, the work that has been developed below has analyzed, from the perspective of the right of access to the jurisdiction, the requirement contemplated in the article and paragraph mentioned in the title of the thesis. This has allowed us to understand that this requirement violates that fundamental right. Likewise, from other categories such as the demand and the requirements of the demand and even the probative freedom, this work has sought to discuss and even brand as superabundant the requirement of witnesses that the Civil Procedure Code demands for prescription demands. domain acquisition. Everything analyzed in the theoretical framework, the pronouncements of the Supreme Court, which have been mentioned in our analysis and discussion of results, have helped us to reach interesting conclusions.
