Abstract: La tesis titulada: “EL ARTÍCULO 505 INCISO 4 DEL CÓDIGO PROCESAL CIVIL Y EL PRINCIPIO A LA TUTELA JURISDICCIONAL EN EL PERÚ”, busca problematizar respecto de uno de los requisitos especiales que la ley (el Código Procesal Civil) exige a aquella persona que busca interponer una demanda de prescripción adquisitiva de dominio.
En tal sentido, el trabajo que a continuación se ha desarrollado ha analizado, desde la óptica del derecho de acceso a la jurisdicción, el que forma parte del macro principio Tutela Jurisdiccional Efectiva; el requisito contemplado en el artículo e inciso mencionados en el título de la tesis. Ello nos ha permitido entender que este requisito resulta atentatorio contra aquel derecho fundamental.
Así mismo, a partir de otras categorías como la demanda y los requisitos de la demanda e incluso la libertad probatoria, este trabajo ha buscado discutir e incluso de tildar de sobreabundante el requisito de los testigos que exige el Código Procesal Civil para las demandas de prescripción adquisitiva de dominio.
Todo lo analizado el marco teórico, los pronunciamientos de la Corte Suprema, que se han mencionado en nuestro análisis y discusión de resultados, nos han servido para arribar a conclusiones interesantes
The thesis entitled: “ARTICLE 505 INCISATION 4 OF THE CIVIL PROCEDURE CODE AND THE PRINCIPLE OF JURISDICTIONAL PROTECTION IN PERU“, seeks to problematize regarding one of the special requirements that the law (the Civil Procedure Code) requires of the person seeking file a claim for acquisitive prescription of ownership.
