The Peruvian State has a Judicial Power, whose objective is to face the legal challenges that may arise in society, providing itself with a staff that is committed to processes of change, transformation and modernity; and that this can generate legal certainty and inspire confidence in citizens, for which it needs to have an appropriate administrative and technological support that allows both to impart and administer justice effectively. However, in our country, this objective has not been able to materialize comprehensively. On the contrary, the traditional delivery and administration of justice has several shortcomings, is inefficient and has even restricted various procedural rights and principles, which has not allowed the expected legal security and confidence of the population to be generated. For this reason, throughout this investigation, we will first address the rights and principles involved in the judicial process. Then, we will identify 04 main problems that afflict our Judicial System: procedural overload and excessive duration of processes, low levels of interoperability, limited access to information and poor predictability of judicial decisions. We will also confirm that, due to the aforementioned problems, judicial processes in Peru are slow, inopportune and inefficient. After that, we will propose the modernization, through the digitalization of the Judiciary, as a possible way to reduce the negative consequences of the traditional delivery and administration of justice, which will allow greater access to it, as well as generate greater speed, efficiency, effectiveness, transparency and predictability. To demonstrate this hypothesis, we will address the evolution and different areas of application of information and communication technologies (ICT) in judicial systems, and how these have generated numerous benefits. We will also address the cases of other nations in the world that have incorporated them into their judicial systems. After that, we will discuss the evolution of the way of imparting and administering justice in our country, including the incorporation of digital tools, before and after the emergence of the COVID-19 pandemic. Finally, we will present a comprehensive proposal for the modernization of our Judicial System that contributes to solving the 04 main problems identified, in addition to other considerations to take into account, and that all these are in accordance with the Peruvian reality and its needs.
