The present research was based on the problem: Is the respect to the plaintiff and/or debtor violated by the interruption of the statute of limitations with the summons of the lawsuit, having as main objective: To analyze if the respect to the plaintiff and/or debtor is violated by the interruption of the statute of limitations with the summons of the lawsuit. The technique used was the survey and the instrument was the questionnaire. The population consisted of the trial lawyers of the Loreto Bar Association, the sample consisted of 80 trial lawyers. The design used in this research is the “non-experimental transactional or transversal type of descriptive level“. For the statistical analysis, descriptive statistics were used to study the variables independently and to demonstrate the hypotheses, the parametric chi-square test (x2) was used. The results indicated that: The interruption of the prescriptive period with the summons of the lawsuit violates the respect for the plaintiff or the debtor, since if the lawsuit is filed on the same day that the right would be prescribing, in itself, the right would already prescribe until it is admitted and notified to the defendant.
