This research aimed to develop the legal impact generated by the criminalization of abortion for pregnant minors under fourteen years of age, as well as their representatives, actions that lead to forced motherhood in Lima. The research analysis was conducted using a qualitative study technique within the scope of basic research, addressing real-world issues through the analysis and interpretation of concepts, characteristics, factors, and factual consequences. A hermeneutic design with a descriptive level was used, aiming to provide a general overview of the information concerning a specific reality, in cooperation with an inductive method. The study population consisted of 10 lawyers specialized in criminal law, procedural criminal law, and constitutional law, including 7 criminal law specialists (independent lawyers and court specialists), 2 independent constitutional lawyers, and 1 judge specialized in Violence against Women and Family Group Members, using a variety of techniques such as interviews, information collection and storage, and document review were employed. The research concluded with a direct assessment of the impact of pregnancy in a minor under fourteen years, classified under Peruvian law as sexual assault, aligning with the protection of the State's legal interest in sexual indemnity, consistent with Plenary Agreement 01-2012/CJ-116 - Supreme Court, 2012, and Article 173° of the Peruvian Penal Code, which sanctions sexual assault against minors under fourteen years of age.
