The purpose of this legal analysis is to examine the main labor aspects derived from the judgment in Case No. 03923-2021 -0-1801-JR-LA-09, issued by the First Permanent Labor Court of Lima. The controversy in this case centers on the labor proceeding initiated for the dismissal of the worker Edgar Cárdenas Toribio against his employer, the outsourcing company Administración de Empresas S.A.C. (hereinafter, the defendant), and the Ministry of Labor and Employment Promotion (hereinafter, MTPE). The plaintiff claims that his dismissal is based on the alleged “extinction of the work center due to force majeure” and consequently, the termination of the contract between AESA and the main company Minera Raura, which constitutes a fraudulent dismissal, since AESA continued hiring personnel for similar positions in other projects. This analysis will address the key concepts highlighted in the case, such as temporary contract, labor outsourcing, denaturalization of outsourcing, the principle of the primacy of reality, the right to work. We will also address the analysis of labor reinstatement and the right of preference in case of collective dismissal, as well as the evidentiary elements necessary to establish the nature of a dismissal as arbitrary and the interpretation of the principle of detachment in the context of outsourcing companies. Finally, this research paper will conclude with a reflection on the impact of the ruling in the Peruvian labor sphere, especially in relation to the denaturalization of outsourcing and the rights of workers in collective dismissals for objective causes, and will evaluate its possible implications for future similar cases.
