Legislative Decree No. 1272 incorporated voluntary correction as an exempt condition from administrative responsibility in the law of general procedure, establishing two requirements forits configuration: willfulness and its completion before the start of the sanctioning procedure. However, it does not require limits on the possibility of correction. That being the case, it becomes clear that deficient legislative regulation can become a perverse incentive for administrators who repeat the commission of an infraction. In that regard, the general objective of this research is to propose application criteria to prevent voluntary correction from becoming a perverse incentive exempt from administrative responsibility in the sanctioning procedure. To support this, the specific objectives are: first, to examine the nature of the sanctioning procedure; second, to analyze the responsibility of the administered offenders; and third, to explain the legal nature and scope of voluntary correction. Regarding the methodology used, it’s been used a qualitative documentary and analytical approach. The results show that the lack of precision on the limits to the possibility of correction causes an undesired effect that becomes a perverse incentive that favors the impunity of the offenders, frustrating the preventive purpose of the sanction and violating the legal principles of regulatory hierarchy, legal certainty, and good faith. Therefore, this document proposes the incorporation of the criteria of nonrecidivism and gradual sanctioning into the Law.
