ABSTRAC The thesis in comment for the title of lawyer raises three theoretical concerns: 1) The theoretical reformulation of the classification of the public worker, which, starting from a sociological concept, leads us to a legal formulation: Senior Civil Servant, Art. 99 of the Constitution and Civil Servant and Public Employee, Law N° 30057 (Mod. Law N° 31299) and D.S N° 040-2014-PCM (Mod. D. S N° 085-2021-PCM); 2) The conceptual differentiation between public official and public employee, foreseen in Administrative Law, is not applicable in Criminal Law; 3) It promotes an adequate application of the Principle of Trust, in the exercise of the jurisdictional function, in order to promote the adequate and transparent use of public resources, specifying guiding criteria for the application of the principle of trust in our national-criminal legal system in order to promote the adequate and transparent use of public resources.
