The research focuses on the analysis of the dispensability of the hearing of protective measures in cases of psychological violence against women, in light of what is established in the ruling of the Constitutional Court in file 03378-2019-PA. Indeed, this paper seeks to analyze the feasibility of dispensing with or not such a hearing in cases of psychological violence with a severe level of risk, evaluating its implications for the protection of victims, the guarantee of fundamental rights and the efficiency of the judicial system. To this end, the work has been organized into three chapters. The first presents a summary of the case contained in the ruling, highlighting key points such as background, main grounds, the ruling and the individual votes of the magistrates. The second addresses the theoretical bases that support this research, defining key concepts on violence against women, as well as its historical evolution, the associated risk factors, and the consequences for the victims. In addition, the applicable national and international regulatory framework is examined. From a procedural perspective, the proportionality test, procedural guarantees, and the criteria for determining protective measures are addressed with special emphasis. Finally, the third chapter carries out an in-depth analysis of the decision made by the Constitutional Court, from which we outline our critical assessment of the importance of holding a hearing on protective measures in cases of psychological violence.
