This report analyzes Ruling No. 461/2023 issued by the Constitutional Court on the constitutional grievance filed by the Organización Regional de los Pueblos Indígenas del Oriente and the Coordinadora Regional de los Pueblos Indígenas-SL against the Ministry of Energy and Mines and the Agency for the Promotion of Private Investment for having omitted prior consultation with the affected communities in the framework of the Concession Contract for the Guaranteed Transmission System of the Project and requested the nullity of: (i) the Ministerial Resolution that approved the Transmission Plan; (ii) the Agreement that governed the public tender; and, (iii) the Concession Contract. The Court declared the claim inadmissible because the controversy no longer exists regarding the Concession Contract and the Resolution and unfounded with respect to the validity of the Agreement. However, it ruled on the relevance of the implementation of prior consultation, establishing that the State has the obligation to carry it out when an administrative measure may directly affect the indigenous peoples. Therefore, this paper analyzes the Court's decision regarding the relevance of the implementation of prior consultation to the case and the opportunity in which this mechanism should be implemented. Our conclusion is that prior consultation is applicable to the granting of the electric concession and must be carried out immediately prior to the granting of the definitive concession by the Ministry of Energy and Mines.
