The present research titled: “The Implications of Determining Controversial Points in the Resolution of Conflicts in the Civil Courts of Cusco, Regarding the Implementation of Oral Proceedings, 2022 – 2024” aims to establish the implications of setting controversial points in the resolution of conflicts within civil oral proceedings in the civil courts of Cusco for the period 2022 – 2024. To achieve this, a qualitative methodological approach was employed, utilizing techniques such as document analysis and interviews. The instruments used included a document analysis form and an interview guide, applied to ten legal practitioners, along with a thorough analysis of relevant orders and judgments. This process seeks to understand how inadequate fixation of controversial points can affect conflict resolution. The findings of the study indicate that the implications of improper determination of controversial points are significant, including challenges to the resolutions that establish them and judgments that resolve controversies based on those points erroneously fixed. Such scenarios not only undermine procedural immediacy but also fail to meet the objectives outlined in Article III of the Preliminary Title of the Civil Procedural Code. The study emphasizes the need for a more rigorous approach in determining controversial points to ensure a more effective justice system that aligns with the principles of civil procedure.
