The general objective of this research was to propose the incorporation of the execution procedure in real estate under the foundation of the commissioner's agreement and Martian agreement contained in legislative decree N°. 28677, law on movable guarantees regulated in Peruvian legislation. The methodology used is qualitative, based on a documentary analysis, taking into account the different study sources, using the recording and documentary review techniques, being the instruments, the observation guide; the textual file, and the documentary analysis guide. During this investigation, the different foundations for the regulatory application and implementation of the execution procedure for real estate guarantees applied in accordance with movable guarantees were analyzed, also having comparative legislation, an ideal perspective of the execution process, opting for the notarial process as an effective and abbreviated source of these processes of execution of these guarantees. It is concluded that the proposal to incorporate the procedure for the execution of reañ esate in Peruvian legislation through the commissioner agreement and the Martian agreement is an issue that requires detailed consideration and legal evaluation, since it implies significant changes in the current system.
