This thesis seeks to analyze how the use of biostatistics in the event of high health risk events affected the right to privacy in Peru with the appearance of COVID 19 in the period 2020-2021. From a perspective of Constitutional Law applied in Peru and abroad. For this reason, it is important to carry out basic or pure research, the purpose of which is to inquire about a topic in contrast to the theoretical bases; and whose approach is qualitative, since narrative records of the phenomena are obtained, object of study by collecting data through interviews carried out with legal professionals. Where the violation of the right to privacy with the misuse and lack of regulation of biostatistics was verified in the face of the health crisis in Peru. Allowing to analyze the measures adopted regarding the protection of personal data and the right to privacy in the Peruvian State and in countries such as Spain, Colombia, and Venezuela. In short, the world is facing a health crisis that has generated the impetus for the creation of a law that regulates the use of biostatistics in the high-risk health field.
