The present investigation had as title "Detentions in flagrante delicto and the police investigation at the Santa Anita Police Station 2020 - 2021", from the district of the same name in the city of Lima, according to the relevant normative, doctrinal and jurisprudential parameters. Having as a general objective: to analyze the police action in the arrest in flagrante delicto and police investigation at the Santa Anita Lima Police Station, 2020 - 2021. The research design has a qualitative approach. The sample consisted of 09 police officers, having formed two groups, one for six (06) participants to whom the interview technique was applied and the other group for three (03) participants for the discussion panel; managing to understand that detention in flagrante delicto, highlighting different limiting behaviors, such as the falsity of information provided by the detainee, the inadequate participation of the Prosecutor and the public defender or a party, before the procedural actions; evidencing that the criteria to preserve the elements of conviction that accredit the criminal act or that is presumed as such are not taken into consideration, not only to facilitate the investigative work, but to guarantee that the criminal process has the procedural guarantees and due process established by law. The study concludes that motorized and foot patrol police must be professional, efficient, effective and respectful of the rights of people, that police actions in interventions for flagrant crimes are carried out respecting the legal framework, considering the crimes of robbery, theft for patrimonial crimes, micro commercialization of drugs and family violence as the most recurrent; that their performance in the police investigation process is crucial, since they are called to be the first investigators at the scene of the crime, in order to gather as much incriminating evidence as possible. However, there is a bit of ignorance in legal matters and procedures under an intervention for crimes in flagrante delicto, which allows us to understand that training must be continuous over time and finally the COVID 19 Pandemic has generated difficulties in the development of investigations, regarding the participation of the RMP in the proceedings carried out at the CPNP Santa Anita.
