The Adverse possession of Real Estate in Perú is regulated in article 950 of the Peruvian Civil Code. It involves the declaration of a new owner concerning a specific real estate, if he has met the requirements of continuous, peaceful and public for at least 10 years. However, the rule establishes a shorter period, which is reduced to 5 years, when the existence of fair title and good faith is verified. For this investigation, we analyze the Cassation No. 2782-2018/Cusco, which addressess the non-application of the law of the Second Instance Chamber, considering that possession with fair valid, and effective title excludes the possibility of acquiring the property through the mechanism of Adverse possession. In response, the Supreme Court annulled the ruling and confirmed the first instance ruling, which declared the petitioner's claim founded. The present work of professional sufficiency will focus on studying the court's decision, providing further analysis regarding the fair title and its scope within the adverse possession, using sources of national and international doctrine, legal journals, among others. Based on what has been stated, the main objective is to delve deeper into the concept and criticize the ruling of the Supreme Court, by virtue of the fact that it did not carry out an analysis of the fair title in the present case or its connection with the registration of the property, being the basis of the plaintiff's interest to act.
