In this research work, it may be noted that not being clear about the parameters of the scope and protection of good faith in the registry could irreversibly and unjustly damage property rights favoring personal rights. Unfortunately, it is with this incongruity that certain courts act with respect to the due protection that corresponds to the right of property against personal rights, which generates processes of nullity of the legal act (registration) which generates an unnecessary procedural burden. It is in this context that the subject of the present intellectual endeavor was selected. Registry good faith is a principle set forth by our civil substantive rule in order to protect the third-party purchaser in good faith. However, how diligent must this third party be, either to acquire or to encumber a real estate? The answer to this question is not seen with the corresponding clarity, because the scope of good faith in the registry is not properly found. Specified, that is, what due diligence proves that a certain person or entity is under the protection of the principle of good faith in the registry.
